Our Eldercare And Medicaid Services

The older we get, the more complicated our financial lives can become. Once someone retires, the time to put together a plan for the future becomes even more important. There are a number of issues that must be addressed to ensure that your assets are preserved for your heirs. This can be accomplished by ensuring you understand the rules which apply to Medicaid, senior healthcare, and long-term care.

The rules for Medicaid are confusing, and the application process can be tedious. We have helped families better prepare for the issues which may prevent them from being eligible for this federal benefit.

None of us knows what the future holds, so the sooner you begin the process of dealing with future medical needs and long-term care needs, the better. There are numerous strategies which can be used to ensure that you will qualify for this benefit when the time comes that you need long-term care services.

We will work with you to create a plan that is based on your financial circumstances, your overall health, and other factors which have to be considered when creating a long-term care plan for you that is easy for your family, and allows you to have the peace of mind of knowing that your family will not be forced to sacrifice the assets you worked so hard to accumulate. Trust Parks Legal, LLC, to guide you. Call 614-427-0426 for legal assistance today.

Medicaid Planning

Since Medicaid is a benefit which is needs based, it is important to plan ahead. This can be done using a host of tools including annuities, trusts, and exceptions which may be granted to help ensure that you qualify. With the high cost of long-term care, either in a skilled facility, or at home, it is important to ensure that your assets are protected for your surviving spouse and your other heirs. We can help make sure that your assets do not become a hindrance to you qualifying for Medicaid.

Medicaid Applications

All benefits applications are complicated, but Medicaid applications can be even more complex than others. Any errors which are made on these applications can result in unnecessary delays, and may also result in a denial of benefits. If you are in need of long-term care, the last thing you want is a delay in having your application processed and approved. We will take the time to work with you to ensure that your application is complete and accurate. Recent changes in the law have made this process even more challenging, so having someone with experience handling the application process is helpful.

VA Benefits

Like Medicaid benefits, if you may be eligible for VA benefits to provide for your long-term care needs, we can help guide you through the process of securing those benefits. Before being considered eligible for long-term care services, you must accept VA healthcare benefits. There are a number of factors which can impact your eligibility, but we can help determine if you are eligible and, if so, help you with the application process. Like Medicaid, the application process can be difficult, but with our experience, you can feel confident that your application will be complete upon submission.

Medicaid Eligibility In Ohio

Medicaid eligibility depends on countable income and assets, and requirements vary by group. Those who may qualify include:

  • An adult under 65 with income up to 138% of the federal poverty level, about $21,597
  • A pregnant woman with a limit of 205% of the federal poverty level, about $32,805
  • A child with a limit of 211% of the federal poverty level, about $33,874
  • A senior with an asset limit of $2,000 for an individual or $3,000 for a couple

Examples of countable income include wages, pension payments, SSDI or SSI income, stocks and alimony payments. Certain benefits, including some types of veterans’ benefits, are non-countable.

Essential Elder Law Documents Beyond Medicaid

To fully address your affairs, it is important to have a range of documents that help you retain control through life stages. Tools to consider include:

  • A durable financial power of attorney: This authorizes a chosen agent to manage your financial affairs.
  • A healthcare power of attorney: With this document, you can appoint an agent to manage medical decisions on your behalf.
  • A living will: This allows you to approve or deny certain types of medical care in advance.
  • A guardianship: When a court declares someone incompetent, a guardian is appointed to make their personal or financial decisions.
  • A conservatorship: A voluntary arrangement that allows a competent adult to appoint someone to help manage their financial affairs when needed.

Our firm can help you with any of this documentation while you address your affairs.

Understanding Long‑Term Care Insurance

Long‑term care insurance is sometimes essential to help cover nursing home or in‑home care costs while reducing reliance on Medicaid. It offers flexibility, but premiums can be high and policies often vary widely. It may be worth considering early, especially if protecting significant assets or experiencing chronic illness are concerns. We can help you explore policies.

Alternatives And Supplements To Medicaid

Not everyone qualifies for Medicaid, even when care is needed. Along with long‑term care insurance, options include Medicare, which serves older adults and some disabled individuals, and private pay strategies using personal assets. Our team can guide you in making informed decisions.
